Abstract:
The primary investigation is considered one of the most dangerous and important stages of the criminal case, so the legislator assigned the authority to carry it out to a specific type of judiciary, which is the investigation judiciary consisting of two levels: the first is entrusted to the investigating judge and the second is undertaken by the accusation chamber. There is no doubt that the presence of the indictment chamber alongside the investigating judge - despite the latter's multiple powers - as a supervisory authority or as a referral body is credited with enforcing the rules of the law and verifying the observance of procedures and guarantees that guarantee personal freedom within the framework of the law. Consequently, the indictment chamber is an organization that not only protects individual rights, but also collective interests.
