Résumé:
Controlling the contractual freedom of the interventionist under the rules of consumer protection has become one of the objectives that the Algerian legislator seeks to achieve, especially after the economic and technological development that the world has witnessed , which has resulted in a change in political, economic and social conditions, And the resulting imbalance of the contract between the parties to the consumer relationship, that is between the consumer and the interventionist, has led to inequality in the legal and economic status between them, particularly since contractual freedom has become unable to provide effective consumer protection and has become a cause of harm to the interests of consumers, resulting in a loss of contractual balance. Which is the issue that the Algerian legislator tried to address by controlling the contractual freedom of the interventionist, by restricting it positively and negatively, with the aim of reaching the lost contractual balance in the relationship of the interventionist with the consumer, thus effectively protecting this latter.
