The real estate has the potential to advance the sustainable development, it’s
also considered as an essential support for the launch of promotional, residential,
urban, industrial, and touristic projects. It contributes to the achievement of
political and social sustainability. In spite of these strategic roles, the latter
remained in Algeria suffering from numerous problems which go back to the
multiplicity of successive legal systems. As a result, an unstable real estate yard
has been created in terms of the identity of its owners, and the legal text which
shall be applied.
The private real estate is the subject of this study, because it occupies an
important position in the life of the individuals, and is connected to the right to
property. In order to enable the citizen to take exclusive possession of his right, the
Algerian legislator surrounded the private real estate possessions with a legal
system, which it may appear to be unable to control the situation of the private real
estate, but it contains effective legal mechanisms to regulate and organize the
situation of the private real estate possessions in Algeria.
This thesis aims at treating the most important legal mechanisms to adjust and
organize the situation of private real estate possessions in Algeria included in the
system of land conservation, and construction contracts.
