Abstract

This thesis deals with the issue of the implementation of judicial rulings and its problems in cases of dissolution of marital union in Algerian law. In this context, what was stated in the general rules of implementation in Algerian law was presented and applied to the judicial rulings issued in cases of dissolution of marital union in both parts, whether those related to the part of the dissolution of marital union in its four forms, or to the part of the consequences of divorce and its effects, as judicial rulings like other rulings without taking into account their distinction, focusing on the most important legal problems that hinder implementation and stand as an impenetrable barrier to the supervising authorities, in the absence of a legal text that regulates such problems, with proposing possible solutions to them. The subject was divided into two parts. The first part was devoted to the implementation of judicial rulings in cases of dissolution of marital union in Algerian law, and included two chapters: the first one dealt with the general framework for the implementation of judicial rulings in cases of dissolution of marital union, while the second chapter dealt with the procedures for implementing judicial rulings rendered in cases of dissolution of marital union. As for the second part, it was devoted to problems of implementation in cases of dissolution of marital union, and was divided into two chapters: the first one dealt with the conceptual framework of implementation problems in cases of dissolution of marital union, and the second chapter was devoted to the applications of the problems of implementing judicial rulings in cases of dissolution of marital union. Finally, the subject was accompanied by appendices supporting the theoretical aspect, and a conclusion summarizing the most important results and suggestions, as well as an appendix to the list of references and to the index.
