Abstract

The United Nations system of human rights is one of the most important achievements of the United Nations Organization, which sought to achieve since its establishment. The Universal Declaration of Human Rights is the basic pillar of this system in addition to the international covenant of civil and political rights and the international covenant of economic, cultural and social rights. Add to that, the basic conventions of human rights in the framework of the UN. The Human Rights Council and the treaties bodies are the most important international committees that control human rights at the UN. In order to carry out its functions these committees adopted working methods of its own. The examination of states reports is the most important mechanism. This mechanism is a periodic surveillance of the achievements and efforts made by states parties for the effective implementation of the treaties. The results in the light of the former mechanism are the best assessment of the situation of human rights within the states parties. These results help the states parties identify the reasons for the shortcomings encountered during the implementation process. As it could be a good opportunity for these states to cooperate with other bodies and to take advantage of their advices. Also, it may be a big chance to get international assistance for the implementation of the international human rights treaties. As a result, the situation of human rights in the world will improve. The reality of international human rights today is alarming. That is mainly due to the gap between the idea and its application. This is what has been ascertained by the results of this study. It showed that the implementation’s rate of the concluding recommendations did not yet amount to the extent desired. This is mainly due to the lack of political will, the lack of financial and human resources, the conflict of national legislation with international standards, the weak judicial systems and their dependency. From the research’s founding, it is suggested that the best way to improve the performance of states towards implementing the concluding recommendations is to develop and adopt the adequate policies and the effective strategies for the advancement of human rights. These policies and strategies must be primarily based on the harmonization of the domestic legislations with international instruments in this regard, the provision of the appropriate materials and human resources, in addition to the reform of the judicial systems. Moreover, there must be a particular focus on developing the human capacities by activating the role of civil society especially in the field of education and training on human rights.
