dc.description.abstract The Algerian legislator worked to establish social security rules in order to protect the worker as a weak part of the employment relationship, this relationship which surrounded him with a set of guarantees to ensure its continuity, seeking to preserve the working position through which working relationships stabilize. Because the preservation of the continuity and stability of the employment relationship is one of the primary concerns of labor legislation, which is achieved by ensuring the continuity of the employment relationship from its conclusion and throughout its period, of validity in the face of anything that interferes with it, and one of the most important indicators indicating the direction of the Algerian legislator towards the strengthening of the principle of preservation of work Extend the application of the system of suspension of the employment relationship, and also approving the rule of continuity of employment contracts when the legal status of the employer organization changes, in addition to this, and since the institution may be exposed to economic conditions which force it to terminate all or part of the employment contracts, the Algerian legislator interferes with these symptoms without prejudice to the workers' right to the continuity of the relationship. Their work, by legislative decree 94/09 relating to the maintenance of employment and the protection of employees liable to lose their job for involuntary reasons, In an attempt to achieve an equation that combines the sustainability of work and its progressive stability from the protective nature that was given to the labor law to replace it with the concept of balance in labor relations, considering that labor legislation is more affected by economic, social and technological factors, which made preserving the position of work a renewed bet in Under the accelerated economic and technological transformations.
