dc.description.abstract In this thesis, we studied the management of the national properties state and which is divided into two masses: the public domain and the private domain, the public property belonging to the state is the group of state property designated for public use or for a public interest, we also dealt with the structural organization of state property interest and real estate conservation, whether at the central or local level, while studying the methods of managing public property belonging to the state, as some licenses and concessions were granted to exploit them and establish in-kind rights on them, especially in light of low oil prices and the state’s resort to searching for new incomes outside for hydrocarbons. The second chapter we discussed the management of private national properties, starting by defining the concept of private national property, then we studied the rules governing the management of private national properties, With emphasis on concession contracts as a mechanism for the management of private national properties, especially after the issuance of Order Number 08/04, whereby the Algerian legislator applied the system of concession in the field of industrial and tourist real estate for investment, as well as in the field of agriculture and in the field of To improve the commercial real estate as well, and through this was reached some observations such as the need to detail the precise issue of property right in real estate resulting from concession. We also discussed the various administrative facilities and advantages granted to investors by the Algerian state for the purpose of achieving economic development and creating jobs for benefit of the unemployed. The study found revealed some contradictions, gaps and ambiguities in the legal texts governing the management of the national properties of the state, particularly real estate. With the various difficulties and obstacles that impede the achievement of investments in national properties, the most important of which is the widespread phenomenon of administrative corruption and bureaucracy.
