Abstract

Crimes against humanity are among the most serious international crimes because they constitute a clear violation of the principles recognized by all mankind. While the violation of the rights of the individual has become a violation of the essential interests of the international legal order, it appears to be an international obligation prohibiting such crimes and the prosecution of their perpetrators by international or hybrid jurisdictions. Much better, states have universal jurisdiction to seize and punish any offender who tries to escape punishment. The jurisprudence of these international or national bodies had played a predominant role in determing the criteria establishing the crime and removing any confusion concerning it. It also clarifed the in criminated facts and their context of applicability in order to prevent the perpetrator of the crime against humanity obeying the political interests of the state from esaping punishment.
