Abstract

Considering that the responsibility is more most important and the more insurant for the second part in the relations between the real estate promoter titular of all necessary permits in the case of his missions, hence we find it and according to general rules that it is constituted from gathering pillars in applications of disposals of the article 124 of the civil code. it can be restrictive and in particular when the responsibility of obligatory coordination lacks, it can be also by a personal action or by others or by things. In addition, it can be contractual when one of the contractual engagements lacks as determinate in samples. Knowing that he has submitted the legislator for responsibilities out of general rules, citing the decanal that concerns constructors for whose are joined with precision persons, acts and nuisances. Also the penal that the legislator has divided into two genders: the penal that fix many sanctions and the administrative reflecting the control of the tutor part of his activity, avec with multitude of engagements that he supports and the hard guarantees fixed for those who he work with. A syndical institution organizing the profession was created« ONPI» from adherent promoters in order to be gathered and to discuss what it imposes.
