dc.description.abstract |
There is no doubt that the Code of Criminal Procedure was not enacted just to punish criminals, but rather to reveal the truth, so that the criminal does not escape punishment and the innocent is not harmed. by the judgment that could be wrongly rendered against him because of suspicion. The law of criminal procedure, with its rules of procedure, must guarantee equal opportunities between the two parties to the criminal dispute and guarantee respect for personal freedom and the public interest, which constitute a vital social interest. To achieve the desired goal of criminal proceedings, they had to be simplified, rapid and clear, so that everyone could defend their rights and freedoms and prevent those in power from violating the freedoms of individuals under the pretext of confusion and disagreement. 'ambiguity in addition to not prolonging the stay of innocent people in the position of the prosecution and not delaying the imposition of the sentence on the perpetrator, in the appropriate legal form and as needed. Accordingly, to combine the interest of the accused and the interest of society, that is, to achieve a legal balance between the public interest and the interest of the accused.And this is what has made modern scientific trends in the field ofcriminal law arouse controversy over procedural issues, as these have necessitated the development of criminal proceedings alongside the evolution of the method of punishment, since the law of criminal procedure is what guarantees the effective practical application of the penal code and the activation of its provisions. In other words, contemporaryism and the inevitable correlation between the alternatives of punishment and the procedural alternatives, so that the idea of limiting traditional punishments is correct with them. |
