Abstract

The subject of our study aims to address one important subject related to real estate development, which is the subject of the ""reservation contract"" which is one of the modern contractual formulas for the sale of building to be built which raises many questions, particularly as regards its legal nature and the obligations of its parties, and the guarantees and legal means put in place to protect the reserve. Through this study, we have tried answering the different questions asked by this contract, so we divided our research subject into two chapters, the first was devoted to the study of the substance of the reservation contract in the sale of building to be built and the conclusion of this contract, the second chapter was devoted to the study of its effects.
